This term, the United States Supreme Court will consider reversing the decades old decision in Abood v. Detroit Public Schools
which found that “fair share” fees are constitutional. The case, Friedrichs v. California Teachers Association,
has the potential to instantly invalidate every fair share fee arrangement in the United States.
This issue is of critical importance to both supporters and opponents of fair share fee arrangements. It has relevance
in the State of Michigan despite the adoption of “Right to Work” legislation in 2012 since there are many agency fee contracts still in effect.
