Granholm Signs Education Budgets

Governor Granholm has signed the Fiscal Year (FY) 2007 Department of Education Budget (SB 1085, PA 332) with only two minor line-item vetoes. Granholm axed a $50,000 addition by the House for the Education Commission of the States and a $25,000 Senate allocation for Michigan History Day. The Department of Education budget totals $90.7 million.

The Governor also signed the K-12 School Aid Budget (SB 1095, PA 342), Higher Education Budget (SB 1088, PA 340) and Community College Budget (SB 1082, PA 341), without vetoes.

Legislative Update

While we have been busy overseeing the budget process, the Legislature has been busy passing laws. Listed below are some of the education-related public acts that were enacted in May, June, and July.

HB 5554 Green School- Establishes a list of activities aimed at protecting the environment and conserving energy as criteria for the designation of a "green school." (Hune) (Public Act 146)

SB 242 Supplemental Appropriations - Provides for supplement and adjustment appropriations for fiscal years ending 2005 and 2006 for various state departments and agencies, including universities and community colleges. (Johnson) (Public Act 153) Effective: 5/25/06 153
 
HB 5760 School Retirees - Extends from July 1, 2006 until July 1, 2011, provisions that allow retired employees to work for certain school districts without a reduction in their retirement allowance. Retirees must have been retired for at least 12 months and they cannot participate in this program for more than 6 years. (Palsrok) (Public Act 158) Effective: 5/26/06
 
SB 1184 Special Education Costs - Specifies that, effective July 1, 2006, the board of a local school district or other public agency responsible for providing programs or services to a child with a disability would be responsible for 75 percent of the costs of providing a due process hearing under the Michigan Administrative Code. (Kuipers) (Public Act 186) Effective: 6/19/06
 
HB 4460 Lock down School Drills - Reduces the number of required fire drills at Statesupported schools from eight to six each school year, and requires at least two "Shelter-In-Place" drills in which the occupants were secured inside the building. (Van Regenmorter) (Public Act 187) Effective: 6/19/06
 
SB 1145 Firefighters Training - Provides civil immunity to institutions of higher education and health facilities that train firefighters. (Cherry) (Public Act 211) Effective: 6/19/06
 
HB 4118 Student Steroid Use - Requires school districts to develop policies indicating that a pupil's use of performance-enhancing drugs would affect his or her eligibility to participate in interscholastic athletics, and require the Department of Community Health (DCH) to distribute to schools a list of performance enhancing substances. (D. Acciavatti) (Public Act 215) Effective: 6/26/06
 
HB 4594 School Steroid Free Zones - Bans possession of anabolic steroids within 1,000 feet of school property and prescribes criminal penalties for individuals 18 years old or older who commit controlled substance offenses on school property. (Mortimer) (Public Act 216) Effective: 6/26/06
 
SB 475 Higher Education - Eliminates the State Research Fund's Feasibility Review Panel. (Hardiman) (Public Act 229) Effective: 6/26/06
 
HB 5977 I.S.D. Academic Year - Allow an intermediate school district (ISD) to provide services to constituent districts before Labor Day under certain conditions; adds an exemption for certain schools from the requirement that a school year not begin before Labor Day; and allows professional development sessions before Labor Day. (Moolenaar) (Public Act 235) Effective: 6/26/06
 
SB 861 Michigan Merit Awards - Eliminates the $1,000 awards currently available under the Act to award qualifiers enrolling in postsecondary institutions outside the State of Michigan. The high school graduating class of 2007 would be the first class ineligible for out-of-state awards; graduates from the class of 2006 would remain eligible for the awards. (Emerson) (Public Act 241) Effective: 6/30/06
 
HB 5479 School Site Plans - Requires public schools, before building or expanding a high school building outside of a city or village, to submit a site plan to the local zoning authority for its review and concurrence. (LaJoy) (Public Act 276) Effective: 7/7/06
 
HB 6069 School Borrowing - Extends the maximum term of certain notes issued by a school board from 12 months to 372 days. (Baxter) (Public Act 285) Effective: 7/10/06 SB 1296 Single Gender Schools - Amends the Revised School Code to permit the establishment of a single-gender school, class, or program within a school if pupils of each gender had access to a substantially equal single-gender and a substantially equal coeducational school, class, or program.(Thomas) (Public Act 303) Effective: 7/20/06
 
HB 5581 Bus Lights - Revises the provision in the law describing what it means for a school bus to be "clearly and continuously visible" to require approaching traffic be able to see the front of a school bus extending from the roofline to and including the headlamps or be able to see the back of the school bus extending from the roofline to and including the tail lamps and stop lamps at distances specified in the act. (Jones) (Public Act 320) Effective: 7/20/06
 
HB 4375 Suicide Risk Curriculum - Encourages schools to provide age-appropriate instruction for pupils and professional development for school personnel concerning the warning signs and risk factors for suicide and depression, and the protective factors that help prevent suicide. The Department of Education must develop or select model programs and materials on suicide prevention and awareness and make those programs and materials available to schools. (Ward) (Public Act 324) Effective: 7/20/06
 
SB 443 Sixth Grade Certificate - Provides that regardless of existing rules, if an individual holds a valid Michigan secondary level teaching certificate, the individual would be certified to teach grade six in their area(s) of endorsement. (Olshove) (Public Act 334) Effective: 8/16/06
 
SB 673 School Administrators - Provides for voluntary certification for school administrators. (Jelinek) (Public Act 335) Effective: 8/16/06
 
SB 1108 Emergency Drills - Requires schools that operates any grades between kindergarten and 12th grade to conduct some of the required emergency drills during lunch or recess, or at other times when a significant number of students are gathered but not in the classroom. (Gilbert) (Public Act 337) Effective: 8/16/06

Michigan Department of Education Regional Update

The Office of Professional Preparation Services will conduct statewide regional information meetings providing an important update on the current status of No Child Left Behind policy and other issues impacting teacher preparation and certification, as well as recent revisions to Criminal Checks for teachers, administrators and educational support staff.

Flanagan Announces Teacher Prep Study Group

Superintendent of Public Instruction Mike Flanagan has announced the creation of a study group to examine teacher preparation programs in Michigan. The Michigan Teacher Preparation Policy Study Group will examine the approval process for college and university teacher preparation programs, as well as teacher testing policies and the grading of said preparation programs and institutions, according to a statement released by the Department of Education.

Michigan State University's Joan Ferrini-Mundy will head new study group, with support from the Department of Education. Mr. Flanagan will be naming the members in late summer or early fall, and the group will report sometime around the new year.

2006 - 2007 Even Start Family Literacy Program Grants

The primary intent of this federal grant is to break the inter-generational cycle of poverty and illiteracy by supporting families through interactive literacy activities between parents and their children, training for parents regarding how to be the primary teachers of their children and full partners in the education of their children, parent literacy training that leads to economic selfsufficiency, and age-appropriate education to prepare children for success in school.

2006 - 2008 Mathematics and Science Partnership Grants

This federal grant is intended to increase the academic achievement of students in mathematics and science by enhancing the content knowledge and teaching skills of classroom teachers. Partnerships between high-need school districts and the science, technology, engineering, and mathematics (STEM) faculty in institutions of higher education are at the core of these improvement efforts.
